The high profile trial of Kyle Rittenhouse demonstrates a serious need.
Prosecuting attorneys have clearly overreached in their efforts to destroy this young man. One of the many problems with our system is that there isn’t much consequence when unscrupulous and politically motivated prosecuting attorneys attempt to destroy someone by using the legal system.
I would like to see these prosecuting attorneys be subject to a percentage of the penalty they wish to impose on their victim, when they are unsuccessful in their attempts.
Send THEM to prison!

Wow. Even excellent prosecutors who have a strong case lose sometimes through no fault of their own. I was always defense counsel. I was the one picking holes in their evidence and arguments. My job wasn’t easy – few resources and high stakes for my client. But the prosecutor’s job was even harder. I made damn sure of it. It’s no shame to come in second in a straight-up fight if you gave it your best. Prosecutors should be prosecuted for cheating, which does happen, but not for losing. If prosecutors were prosecuted for losing, there would not be many trials.
