Today the “Supreme” Court struck down a Texas pro life law.
Justice Kennedy was the “swing” vote, joining other leftist Justices in the decision.
The law required abortion clinics to meet medical standards and required abortionists to have admitting privileges within 30 miles of the clinic. The killing of an unborn baby is a surgical and/or medical procedure which can create complications requiring emergency hospital attention. It would not seem unreasonable to require the physician performing these “procedures” to work in a clinic that meets medical standards, and have the ability to admit a woman to a local hospital for emergency care when something goes wrong.
When I served in the Legislature I authored a law which required South Dakota abortion clinics to be inspected annually by the department of health. Prior to the passage of that bill, abortion clinics were not subject to any inspections.
Justice Clarence Thomas wrote a dissent that expressed the sentiments of many disappointed pro-life advocates:
“The Court has simultaneously transformed judicially created rights like the right to abortion into preferred constitutional rights, while disfavoring many of the rights actually enumerated in the Constitution, but our Constitution renounces the notion that some constitutional rights are more equal than others. … A law either infringes a constitutional right, or not; there is no room for the judiciary to invent tolerable degrees of encroachment. Unless the Court abides by one set of rules to adjudicate constitutional rights, it will continue reducing constitutional law to policy-driven value judgments until the last shreds of its legitimacy disappear.”
